Bell Morgan is a real estate business. We identify and present property opportunities and assist with property-related enquiries and transactions. We do not establish SMSFs or advise whether a person should establish or use an SMSF. Where appropriate and with express consent, we may introduce clients to independent qualified professionals.
1. Introduction
Bell Morgan respects the privacy of the people who engage with our business and is committed to protecting the personal information entrusted to us.
This Privacy Policy explains how BMA REAL ESTATE PTY LTD (ABN 41 623 694 744; ACN 623 694 744), trading as Bell Morgan (Bell Morgan, we, us or our), collects, holds, uses and discloses personal information.
This policy applies when you visit our website, enquire about a property, register your interest in purchasing or investing in property, request an appointment, communicate with one of our representatives, attend an event or otherwise interact with Bell Morgan.
Bell Morgan is a real estate business that identifies and presents property opportunities, including new-build and development properties selected using Bell Morgan's property research and assessment criteria. Some properties we present may be considered by clients who are seeking to purchase an investment property through an existing or proposed self-managed superannuation fund (SMSF).
Where an enquiry involves the possible use of an SMSF to purchase property, Bell Morgan may, with the prospective purchaser's express consent, introduce them to appropriately qualified third-party service providers. These may include licensed financial advisers, accountants, registered tax agents, lawyers, licensed mortgage brokers, lenders, SMSF establishment or administration providers, auditors and other relevant professionals.
Bell Morgan handles personal information in accordance with the Privacy Act 1988 (Cth), the Australian Privacy Principles where they apply to us, the Spam Act 2003 (Cth), the Do Not Call Register Act 2006 (Cth) and other applicable Australian privacy, direct marketing and communications laws.
2. Bell Morgan's role
Bell Morgan provides real estate and property-related services. We may provide information about available properties, property developments, builders, developers, purchasing processes and related property services. We may discuss your stated property preferences and identify property opportunities that appear relevant to those preferences and Bell Morgan's property-selection criteria.
Bell Morgan's role is limited to property-related services. Unless expressly stated otherwise, Bell Morgan does not provide financial product advice, taxation advice, legal advice, SMSF establishment advice, SMSF administration services or credit assistance. We do not recommend whether you should establish, retain or use an SMSF, transfer superannuation benefits, borrow through an SMSF or acquire a particular property through an SMSF.
Information appearing on our website or provided through our advertisements, representatives, events or communications is general in nature. It does not take into account your financial circumstances, objectives, needs, tax position, SMSF investment strategy or legal circumstances and should not be treated as personal financial, tax, legal or credit advice.
Bell Morgan's identification or presentation of a property does not amount to a representation that the property is suitable for you or your SMSF, that an SMSF is permitted or financially able to acquire it, or that the property will achieve a particular capital growth, rental return, occupancy, taxation or other investment outcome.
Where you require financial, accounting, taxation, legal, lending or SMSF services, Bell Morgan may offer to introduce you to an independent and appropriately qualified provider. That provider is responsible for its own advice, recommendations, services, licensing obligations and subsequent handling of your personal information under its own privacy policy. Bell Morgan remains responsible for ensuring that its own collection, use and disclosure of personal information complies with applicable law.
Submitting an enquiry to Bell Morgan does not establish a financial adviser-client, accountant-client, lawyer-client, lender-borrower, credit representative-client or SMSF administration relationship with Bell Morgan.
3. The personal information we collect
Personal information is information or an opinion about an identified individual or an individual who is reasonably identifiable.
The kinds of personal information we collect depend on how you engage with Bell Morgan and the nature of your enquiry.
We may collect your name, telephone number, email address, residential address, suburb, state, postcode, age or age range, occupation, employment status and preferred method of contact.
Where you make a property enquiry, we may collect information about the type of property you are interested in, preferred locations, intended purchasing timeframe, approximate purchasing budget, deposit, finance requirements, property ownership history and whether the proposed purchase is for residential or investment purposes.
We may also ask about your property preferences and purchasing objectives, the number of proposed purchasers, whether you are an Australian resident and whether you are already working with a real estate agent, buyer's agent, financial adviser, accountant, lawyer, lender or mortgage broker.
Where your enquiry relates to acquiring property through an SMSF, we may collect general information about whether you currently have an SMSF, whether you are considering establishing one, whether another member or trustee is involved, whether the SMSF has already been established and whether you require assistance from a financial adviser, accountant, lawyer, mortgage broker, lender or SMSF administration provider.
Where reasonably necessary to understand the nature of your enquiry or arrange an appropriate professional referral, we may ask for a broad indication of the amount held in superannuation or the proposed deposit. Bell Morgan does not ordinarily require detailed superannuation account information, complete financial statements or detailed personal financial information during an initial property enquiry.
We may collect records of your communications with us, including emails, telephone enquiries, form submissions, appointment information, property preferences, questions, feedback and complaints. Where calls are recorded, we will take reasonable steps to notify you at or before the recording begins.
We may also collect information about how you found Bell Morgan, the advertising campaign or referral source associated with your enquiry, your marketing preferences and records showing when and how you provided, changed or withdrew your consent.
When you use our website, we or our technology providers may automatically collect technical information. This may include your internet protocol address, device type, browser type, operating system, approximate location, pages viewed, links selected, referring website, session information and the date and time of your visit.
We do not ordinarily require sensitive information as part of an initial property enquiry. You should not provide tax file numbers, account passwords, banking credentials, identity documents, detailed health information or other highly sensitive information through a general website enquiry form unless we have specifically requested it through an appropriate and secure process.
4. How we collect personal information
Bell Morgan generally collects personal information directly from you.
We may collect information when you complete an online enquiry form, register your interest in a property, request a property brochure or information pack, book an appointment, subscribe to communications, speak with a representative, send us an email, contact us by telephone, attend an event or engage with our website, advertising or social media pages.
We may also receive personal information from a joint purchaser, family member, representative or another person acting on your behalf.
In some circumstances, information may be received from a property developer, builder, project marketer, real estate representative, referral business, financial services provider, mortgage broker, accountant, advertising provider or lead-generation service. We will only use information obtained from another source where the collection is reasonably related to our business activities and permitted by law.
Where another organisation provides your information to Bell Morgan, we may take reasonable steps to confirm the source of the information, the circumstances in which it was collected and whether you agreed to being contacted.
If you provide us with personal information about another person, you should have their authority to do so and should make them aware of this Privacy Policy.
5. Why we collect and use personal information
Bell Morgan collects and uses personal information so that we can understand and respond to your enquiry and provide property-related services.
We may use your information to provide property details, discuss your stated preferences, identify property opportunities that appear relevant to those preferences and Bell Morgan's selection criteria, arrange an appointment, inspection or consultation, provide requested documents and communicate with you about a proposed property purchase.
Where you have expressed an interest in acquiring property through an SMSF, we may use your information to understand the general nature of your enquiry, identify the types of professional assistance you may require and, with your express consent, arrange contact from an appropriately qualified third-party provider.
We may use personal information to facilitate communications between you and builders, developers, property representatives and professional service providers involved in a proposed transaction.
We may also use personal information to administer our business, maintain enquiry and transaction records, manage appointments, improve our services, train and supervise staff, undertake quality assurance, analyse advertising performance, identify enquiry sources, manage our website and systems, detect fraud or misuse, respond to complaints and comply with legal and regulatory obligations.
Information provided through an initial enquiry is not used by Bell Morgan to determine that an SMSF, borrowing arrangement, property or investment strategy is suitable for you. Any personal assessment must be undertaken by an appropriately qualified and, where required, licensed professional after considering your individual circumstances.
If you do not provide the information reasonably required to process your enquiry, Bell Morgan may be unable to contact you, provide relevant property information, arrange an appointment, introduce you to an appropriate service provider or assist with a proposed property transaction.
6. SMSF-related enquiries
An SMSF is a regulated superannuation structure. Establishing and operating an SMSF, borrowing through an SMSF and acquiring property using SMSF money may involve financial services, superannuation, taxation, lending, trust, legal and property law considerations.
Bell Morgan's role in an SMSF-related enquiry is limited to providing property information, discussing property preferences, presenting potentially relevant property opportunities, facilitating the property enquiry and, where expressly authorised, introducing you to relevant independent professional service providers.
Bell Morgan does not establish SMSFs and does not advise whether you should establish or use an SMSF. An indication that a property may be capable of being acquired by an SMSF, or is being marketed to SMSF purchasers, is not a representation that the property is suitable for your SMSF or that your SMSF is permitted or financially able to acquire it.
Whether a proposed purchase is appropriate and legally permissible will depend on matters such as the SMSF trust deed, investment strategy, available funds, borrowing structure, lender requirements, related-party rules, sole-purpose requirements, liquidity, diversification, insurance needs and the circumstances of the SMSF members.
Bell Morgan does not assume that an SMSF is appropriate for you merely because you have submitted an enquiry or expressed an interest in purchasing property through superannuation.
Before establishing an SMSF, transferring superannuation benefits, arranging an SMSF loan or entering a property transaction, you should obtain advice from appropriately qualified and, where applicable, licensed financial, accounting, taxation, legal and credit professionals.
7. Disclosure to third parties
Bell Morgan may disclose personal information where doing so is reasonably necessary to respond to your enquiry, provide our services, facilitate a proposed transaction or operate our business. Information may be disclosed internally to Bell Morgan's employees, directors, representatives, contractors and consultants who require access to perform their duties.
Depending on the nature of your enquiry, we may disclose information to property developers, builders, project marketers, real estate agents, buyer's agents, sales representatives, conveyancers, valuers, property researchers, settlement agents and other property-sector participants.
Where an enquiry involves an SMSF or related professional services, we may, with your express consent, disclose relevant information to Australian financial services licensees and their authorised representatives, licensed financial advisers, accountants, registered tax agents, lawyers, Australian credit licensees, licensed mortgage brokers, lenders, SMSF establishment providers, administrators, auditors and other appropriately qualified professionals.
We may also disclose information to customer relationship management providers, cloud storage providers, website hosting providers, email and telephone providers, appointment-booking services, data analytics providers, advertising platforms, cybersecurity providers and other businesses that provide operational services to Bell Morgan.
Information may be disclosed to our professional advisers, insurers, auditors and consultants, or to regulators, courts, tribunals, law enforcement agencies and government bodies where the disclosure is required or authorised by law.
We will generally limit disclosures to information reasonably required for the recipient to contact you, respond to the enquiry, provide a requested service or perform its role in the proposed transaction. Where practicable, Bell Morgan will identify the proposed recipient or category of recipient when your information is collected or before it is disclosed.
An independent third-party provider is responsible for its own advice, recommendations, services, licensing obligations and subsequent handling of your personal information under its own privacy policy. Bell Morgan remains responsible for the lawfulness of its own collection, use and disclosure of your personal information.
8. Referrals and commercial arrangements
Bell Morgan may have commercial arrangements with some property developers, builders, project marketers and professional service providers.
Under these arrangements, Bell Morgan may receive a sales commission, marketing payment, referral fee or other benefit when a property is purchased, an introduction results in a service being provided or another agreed event occurs.
The existence of a commercial arrangement does not mean that a particular property, SMSF, financial product, loan, provider or investment strategy is suitable for you.
Where required, information about commissions, referral fees or other material benefits will be disclosed separately in accordance with applicable real estate, financial services, credit or other legal obligations.
Bell Morgan does not sell personal information to unrelated organisations for their unrestricted use. Where information is provided to a referral partner, it is disclosed for the purpose explained to you, such as responding to your SMSF or property enquiry, arranging professional assistance or facilitating a proposed transaction.
9. Consent to professional referrals
Bell Morgan will ordinarily seek your express consent before providing your contact details or enquiry information to an independent financial adviser, accountant, tax agent, lawyer, mortgage broker, lender, SMSF provider or other professional referral partner.
Consent may be obtained through an online form, recorded telephone discussion, email, SMS, signed document or another clear method. We will seek to identify the proposed recipient or the relevant category of recipient and the purpose of the referral.
Consent to a professional referral is separate from consent to receive general marketing communications from Bell Morgan or another organisation.
You may withdraw your consent before a referral is made by contacting Bell Morgan. Once information has been lawfully disclosed to an independent provider, that provider may hold and use the information under its own privacy policy and legal obligations.
10. Direct marketing
Bell Morgan may contact you by telephone, email, SMS, direct message or another method to respond to an enquiry you have submitted and provide information directly related to the property or service about which you contacted us.
Subject to your consent and applicable law, we may also contact you about other properties, developments, investment property opportunities, market updates, events, seminars and services that may be relevant to your interests.
Where you separately agree to receive communications from a third-party provider, that provider may contact you about the aspect of your enquiry referred to it.
You may withdraw your consent or opt out of Bell Morgan's marketing communications at any time by using the unsubscribe facility contained in an email or SMS, replying STOP where that option is provided, asking a caller not to contact you again or contacting our Privacy Officer.
Bell Morgan will process valid opt-out requests within the period required by applicable law. We may retain a limited suppression record containing your contact details so that we can continue to respect your request.
Opting out of marketing does not prevent Bell Morgan from contacting you where reasonably necessary to respond to an active enquiry, administer an existing transaction, provide requested information, address a complaint or comply with a legal obligation.
Where marketing activities are undertaken on Bell Morgan's behalf by another organisation, we take reasonable steps to require that organisation to comply with applicable consent, identification, calling-time and unsubscribe requirements.
11. Overseas disclosure and processing
Bell Morgan may use technology, cloud, communications, analytics, advertising and operational service providers whose systems, personnel or related entities are located outside Australia.
As a result, personal information may be stored, processed or made accessible outside Australia. The countries involved depend on the providers used and may include the United States and other jurisdictions in which those providers or their subcontractors operate. Because providers and hosting arrangements may change, it may not always be practicable to specify every country in which information may be handled.
Before disclosing personal information to an overseas recipient, Bell Morgan will take reasonable steps required by applicable law to protect the information and to ensure that the disclosure is consistent with the purpose for which the information was collected or otherwise authorised.
Some services, including social media, online advertising and analytics platforms, may collect information directly from your browser or device and handle that information under their own privacy policies.
12. Cookies, analytics and advertising technologies
Bell Morgan's website may use cookies, pixels, tags, local storage and similar technologies.
These technologies may be used to operate the website, maintain website security, remember preferences, understand how visitors use the website, identify the source of an enquiry, measure advertising performance, improve website content and present advertising that may be relevant to users.

14. Call recording and electronic communications
Bell Morgan may record telephone calls for training, monitoring, quality assurance, dispute resolution, compliance and record-keeping purposes.
Where a call is recorded, Bell Morgan will provide notice where required. If you do not wish to be recorded, you may request another reasonable communication method where available.
Emails, SMS messages and other electronic communications may be retained as part of Bell Morgan's business records.
Bell Morgan does not guarantee that email or other electronic communication methods are completely secure. You should avoid sending highly sensitive information through unsecured channels.
15. Security of personal information
Bell Morgan takes reasonable steps to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure.
Our security arrangements may include access controls, password and authentication requirements, system permissions, secure hosting, encryption where appropriate, network and device security, staff training, confidentiality obligations, software updates, backups and procedures for responding to suspected security incidents.
Access to personal information is restricted to people who reasonably require it to perform their duties or provide services to Bell Morgan.
While Bell Morgan takes reasonable precautions, no internet transmission, website, email system or electronic storage method is completely secure. You should take reasonable care when transmitting personal information electronically.
16. Data breaches
Bell Morgan maintains procedures for identifying, assessing and responding to suspected data breaches.
Where Bell Morgan becomes aware of unauthorised access to, disclosure of or loss of personal information, we will take reasonable steps to contain the incident, investigate what occurred, reduce potential harm and prevent recurrence.
Where the incident is an eligible data breach under the Privacy Act, Bell Morgan will notify affected individuals and the Office of the Australian Information Commissioner as required.
17. Retention and destruction
Bell Morgan retains personal information for as long as it is reasonably required to respond to enquiries, provide services, facilitate transactions, maintain consent and referral records, manage complaints, resolve disputes and comply with legal, taxation, insurance and regulatory obligations.
The applicable retention period may depend on the nature of the information, whether an enquiry proceeded to a transaction, the involvement of a third-party provider, limitation periods and any applicable record-keeping requirements.
Where personal information is no longer reasonably required for a permitted purpose, Bell Morgan will take reasonable steps to securely destroy or permanently de-identify it, unless its retention is required or authorised by law.
Bell Morgan may retain limited contact information on a suppression list where this is necessary to ensure that an opt-out or do-not-contact request continues to be respected.
18. Access to personal information
You may request access to personal information Bell Morgan holds about you.
Requests should be submitted to our Privacy Officer using the contact details at the end of this policy. To protect your privacy, we may ask you to verify your identity before providing access.
Bell Morgan will respond within a reasonable period.
In some circumstances, access may be refused or limited where permitted by law. For example, access may be refused where providing it would unreasonably affect another person's privacy, reveal commercially sensitive information, prejudice an investigation or be unlawful.
Where access is refused, Bell Morgan will generally provide written reasons and explain the available complaint options.
Bell Morgan does not charge a fee for submitting an access request. We may charge reasonable administrative costs associated with providing access where permitted by law, but we will inform you before incurring those costs.
19. Correction of personal information
Bell Morgan takes reasonable steps to ensure that the personal information it holds is accurate, current, complete, relevant and not misleading.
You may ask us to correct information that you believe is inaccurate, out of date, incomplete, irrelevant or misleading.
Where we agree that information should be corrected, we will take reasonable steps to update our records. Where appropriate and reasonably practicable, we may also notify a third party to whom the incorrect information was previously disclosed.
If we refuse a correction request, we will generally provide written reasons and information about how you may make a complaint. You may also ask us to associate a statement with the information recording your view that it is inaccurate.
20. Anonymity and pseudonyms
Where practicable, you may interact with Bell Morgan anonymously or by using a pseudonym.
However, Bell Morgan may be unable to provide property information, arrange an inspection or appointment, introduce you to another provider, verify your eligibility, facilitate a transaction or comply with legal obligations unless you provide accurate identifying and contact information.
21. Privacy complaints
If you have a question or complaint about Bell Morgan's handling of your personal information, please contact our Privacy Officer.
Your complaint should provide sufficient detail to allow us to understand and investigate your concerns.
Bell Morgan will acknowledge the complaint and take reasonable steps to investigate and respond within a reasonable period. We may contact you for further information during the investigation.
If you are not satisfied with Bell Morgan's response, you may be entitled to complain to the Office of the Australian Information Commissioner.

Concerns about unsolicited commercial electronic messages or telemarketing may also be raised with the Australian Communications and Media Authority.
22. Third-party websites
The Bell Morgan website may contain links to websites operated by property developers, builders, financial advisers, accountants, lawyers, mortgage brokers, lenders, government agencies or other third parties.
Bell Morgan is not responsible for the content, availability, security or independent privacy practices of a third-party website.
You should review the privacy policy and terms of the relevant third party before providing personal information through its website.
23. Changes to this Privacy Policy
Bell Morgan may update this Privacy Policy from time to time to reflect changes to our business, services, referral arrangements, technology, information-handling practices or legal obligations.
The current version will be published on the Bell Morgan website and will show the date on which it was last updated.
Material changes may also be communicated through the website or another appropriate method.
This website's forms and tools
Added 2 October 2026 for the new bellmorgan.com.au, which collects less than the enquiry forms described above.
When you request a callback, we collect the details you choose to provide: your first name, your mobile number, an optional email address, how you’re thinking of buying, whether you’ve spoken with a lender or broker (if you’re buying with savings or a loan), whether you already have a self-managed fund (if you’re buying through one), your preferred call window, your question, and your Pathfinder answers if you request a callback in the same visit. The form shows those answers, so you can remove them before you send the request. A guide or calculator email request collects your email address and, for the calculator, the figures needed to produce the result you asked for.
We use these details to respond to the request, keep a record of it and manage the follow-up. A requested guide or result is sent as a single email. Submitting a form does not subscribe you to marketing.
The website runs on Cloudflare, which delivers the pages, protects the forms and stores each request, and enquiries are managed in Pipedrive. Both may process information outside Australia.
Answers you give the Pathfinder and the calculator stay in your browser tab and are cleared when it closes. Nothing is sent to us unless you submit a form.
Optional advertising measurement is off unless you allow it under Privacy choices. When it is allowed, an accepted enquiry is reported to the advertising platform with hashed contact details only. Your question, how you’re thinking of buying, your follow-up answers, your Pathfinder answers and your calculator figures never enter advertising events.
